Rental Agreement
Please read the rental agreement carefully before renting equipment from Dive Centre Bondi.
This Rental Agreement (the "AGREEMENT") is entered into between Dive Centre Bondi ("the RELEASED PARTIES") and the person renting equipment ("the RENTOR") for the rental of scuba and/or skin diving equipment.
By renting equipment from Dive Centre Bondi, the RENTOR acknowledges that they have read, understood and agreed to all of the terms set out below.
1. Acknowledgement & Assumption of Risk
This AGREEMENT is entered into for the rental of scuba and/or skin diving equipment. This AGREEMENT is a release of the RENTOR's rights to sue for injuries or death resulting from the rental and/or use of the equipment.
The RENTOR expressly assumes all risks of skin and/or scuba diving related in any way to the rental and/or use of this equipment.
The RENTOR hereby acknowledges receipt of the equipment designated in the attached receipt, and, if any of this equipment is to be used for scuba diving, that the RENTOR is a certified scuba diver or student in a scuba diving course/program under the supervision of a certified scuba instructor.
2. Inspection of Equipment
The RENTOR acknowledges that the equipment is in good working condition and that he/she/they have examined the equipment to ensure it is free from defects, including checking both the quality and quantity of gas in any scuba tank(s) rented.
3. Use of Equipment
Each RENTOR is permitted to rent only one set of dive equipment and one scuba tank per rental period. Equipment is not to be shared, sub-rented, or used by any person other than the RENTOR listed on this agreement.
4. Released Parties & Limitation of Liability
The RENTOR also understands that Dive Centre Bondi and its employees, owners, or agents (hereinafter "RELEASED PARTIES") shall not be held liable or responsible in any way for any injury, death, or other damages to the RENTOR or his/her/their family, heirs, or assigns, which may occur as a result of the rental and/or use of the equipment, or as a result of product defect or the negligence of any party, including the RELEASED PARTIES, whether passive or active.
5. Acknowledgement & Release
I HAVE CAREFULLY READ AND UNDERSTAND THE ABOVE AGREEMENT. BY SIGNING THIS AGREEMENT, I EXEMPT AND RELEASE DIVE CENTRE BONDI, AND ALL RELATED ENTITIES AS DEFINED ABOVE, FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH AS A RESULT OF RENTING AND/OR USING THE EQUIPMENT, HOWEVER CAUSED, INCLUDING BUT NOT LIMITED TO PRODUCT LIABILITY OR THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE.
ALSO, BY SIGNING THIS AGREEMENT, I AUTHORIZE DIVE CENTRE BONDI TO CHARGE MY CREDIT CARD IF THE AGREED RENTED EQUIPMENT IS NOT RETURNED OR IS IRREPARABLY DAMAGED IN ANY WAY.
